COVID-19 and the Family Courts embracing technology

It is clear we are living through a once in a generation crisis, with some unique challenges ahead of us, with many people working from home, or in self-isolation. It could be hard to think how the Justice system, known as it is for old traditions, courtroom confrontations, and not for its embrace of technology, would adapt to these times.
The Courts have made several changes in response. First of all, they have reduced the number of Courts open to the public (Link), rescheduling hearings to a later date or moving hearings into the virtual realm, an area which the courts have historically been slow at adopting.
The Family Court specifically has addressed the need to shift to a more COVID-19 safe approach, issuing guidance that we must “Keep Business Going Safely” and embrace technology as much as possible. With this they have directed the family courts (and so our department) to use the long-overlooked procedures for remote hearings and use of technology to aid the court.
This means in the majority of cases hearings should be heard remotely, either using conference calls, video or Skype calls. This does not mean that court-based hearings will not happen, as there may well be situations where it would be inappropriate (or be detrimental to justice) to use technology. It is up to the Judge (or Magistrate) to decide and let the parties know how the hearing will go ahead, but it is also open for either party to request that a hearing be held remotely.
The Family Courts have also decided to, wherever possible, use Emails to submit documents to them rather than posting large court bundles to each of the parties.
